Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of PJais, including our desktop application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Definitions

• "Service" refers to the PJais application, website, and all related services
• "User," "you," and "your" refer to the individual or entity using the Service
• "We," "us," and "our" refer to PJais and its operators
• "Content" refers to text, data, information, and materials you create or upload
• "Account" refers to your registered user account with PJais

Eligibility

To use PJais, you must:

• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration and Security

Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

License and Usage Rights

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the PJais application on devices you own or control
• Access and use the Service for your personal or internal business purposes
• Create and manage AI personas and conversations

Usage Restrictions

You agree NOT to:

• Reverse engineer, decompile, or disassemble the application
• Remove or modify any proprietary notices or labels
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to transmit malware, viruses, or harmful code
• Violate any applicable laws or regulations
• Resell, redistribute, or sublicense the Service
• Use the Service to harass, abuse, or harm others

Subscriptions and Payments

Subscription Plans

PJais offers various subscription plans with different features and pricing. By subscribing, you agree to:

• Pay all applicable fees for your chosen plan
• Provide valid payment information
• Authorize automatic recurring charges (for monthly/annual plans)
• Pay all applicable taxes

Billing and Renewals

Subscriptions automatically renew at the end of each billing period unless canceled. You will be charged the then-current rate for your plan. We will provide notice of any price changes.

Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We offer a 14-day money-back guarantee for new subscriptions. Refunds are not provided for partial billing periods.

Free Trial

We may offer free trials for certain plans. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends.

User Content and Data

Your Content

You retain all rights to the content you create using PJais, including:

• AI persona configurations
• Conversation history
• Custom prompts and templates
• Any other data you input into the Service

License to Your Content

By using the Service, you grant us a limited license to:

• Store and process your content to provide the Service
• Create backups for data protection (if cloud sync is enabled)
• Use anonymized, aggregated data to improve the Service

We will never use your personal conversations or data for AI training or share them with third parties without your explicit consent.

Content Responsibility

You are solely responsible for your content and the consequences of creating, uploading, or sharing it. You represent that you have all necessary rights to your content and that it does not violate any laws or third-party rights.

Third-Party AI Services

PJais allows you to connect to third-party AI services (such as OpenAI, Anthropic, etc.) using your own API keys. You acknowledge that:

• Your use of third-party services is subject to their respective terms and policies
• We are not responsible for the availability, performance, or content of third-party services
• You are responsible for any costs associated with third-party API usage
• We do not control or endorse third-party services
• Your API keys are stored locally and encrypted on your device

Intellectual Property

The Service, including its design, features, functionality, and content (excluding user content), is owned by PJais and protected by copyright, trademark, and other intellectual property laws.

"PJais" and our logos are trademarks of PJais. You may not use our trademarks without our prior written permission.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of AI-generated content
• Warranties that defects will be corrected

You use the Service at your own risk. We do not guarantee that AI-generated content will be accurate, appropriate, or suitable for your purposes.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PJAIS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or data loss
• Damages resulting from third-party AI services
• Unauthorized access to your data

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify and hold harmless PJais and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or data

Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
